EPA Revoked WOTUS – What’s Next?

On September 11, 2019, the EPA announced the formal revocation of the Clean Water Act “waters of the United States” (WOTUS) rule. The U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers created the WOTUS rule in 2015 in an attempt to expand protections of wetlands connecting to navigable waterways. Challenges to the WOTUS rule centered on
